Employ Well+ Terms and Conditions

Welcome to Employ Well+. By accessing or using the Employ Well+ platform (“Platform”), you agree to be bound by the following Terms and Conditions. Please read them carefully before participating in any programs, courses, or activities.
 

1. Nature of Services

Employ Well+ provides access to online courses, wellness resources, educational content, and identity protection tools (“Services”). These Services are designed for informational and educational purposes only.

Employ Well and its partners are not medical professionals, and the Services do not replace medical advice, diagnosis, or treatment. Always consult your physician or qualified health provider before starting any new health, fitness, or nutrition program.

2. Voluntary Participation & Assumption of Risk

Participation in Employ Well+ courses, wellness activities, or programs is entirely voluntary. By using the Platform, you acknowledge and agree that:

  • You are solely responsible for your health, safety, and wellbeing when engaging with the content.

  • Some programs may involve physical activity, exercise, or dietary changes. You participate at your own risk.

  • Employ Well is not liable for any injuries, adverse reactions, or damages that may result from participation.

3. No Guarantees of Results

Employ Well does not guarantee any specific outcomes from use of the Platform, including but not limited to physical, mental, or financial improvements. Individual results may vary.

4. User Conduct

You agree not to misuse the Platform. Prohibited actions include, but are not limited to:

  • Sharing or redistributing course content without permission.

  • Using the Platform for unlawful purposes.

  • Attempting to reverse-engineer, hack, or interfere with the Platform’s operation.

5. Intellectual Property

All course content, videos, text, images, and other materials provided on the Platform are the property of Employ Well or its licensors. You may access and use the content solely for personal, non-commercial purposes. Unauthorized use or distribution is strictly prohibited.

6. Third-Party Services

The Platform may include content, links, or services provided by third parties (e.g., meditation guides, fitness instructors, nutritionists). Employ Well does not control or endorse third-party content and is not responsible for their accuracy, reliability, or safety.

7. Limitation of Liability

To the maximum extent permitted by law, Employ Well, its affiliates, and partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform or participation in any course or activity.

8. Indemnification

You agree to indemnify and hold harmless Employ Well, its affiliates, employees, contractors, and partners from any claims, damages, or expenses arising out of your use of the Platform, including any actions you take based on the content provided.

9. Termination of Access

Employ Well reserves the right to suspend or terminate access to the Platform at any time, for any reason, without notice.

10. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles.

11. Changes to Terms

Employ Well may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

Employ Well Terms & Conditions

These Terms govern your access to and participation in employee wellness programs facilitated by Employ Well.

1. Program Overview: Employ Well provides administrative services for tax-advantaged employee benefits using IRS Sections 125, 105, 213(d), and 62(a). These programs are offered in partnership with IRS-audited vendors.

2. No-Cost Enrollment: Your participation in these programs does not reduce your take-home pay. In fact, it may increase it by lowering taxable income. Enrollment is automatic unless you opt out within the time window communicated by your employer.

3. Employee Consent: By not submitting an opt-out form within the communicated deadline, you authorize Employ Well and its partners to:

  • Use your personal information for benefit activation

  • Submit enrollment forms on your behalf

  • Manage benefit administration in partnership with your employer

4. Access and Use: Some benefits may be accessed through our digital wellness platform. You agree to use these services in accordance with applicable laws and respectful community standards.

5. Dispute Resolution: Any concerns or disputes should first be submitted to admin@employwellprogram.com. Employ Well reserves the right to modify or terminate benefits as required by law or contract.

6. Limitation of Liability: Employ Well is not responsible for third-party service outcomes. We act solely as an administrative and coordination partner on behalf of your employer.

7. Wellness Portal Access and Credit Distribution: Employ Well provides access to a digital wellness portal containing courses, guided meditations, downloads, and other holistic tools. As part of the program, employees may receive monthly digital credits or coupons redeemable within the wellness portal.

The amount of credits issued per employee may vary and is based solely on the level of payroll tax savings generated by their specific employment and wage profile. These calculations are made using IRS-compliant savings formulas and do not impact your pay.

Employ Well does not discriminate against any employee on the basis of age, gender, race, religion, sexual orientation, national origin, health status, income level, or job classification. All employees eligible under their employer’s payroll program will receive access to the portal and their respective credits in accordance with available savings.

8. Platform Modifications: Employ Well reserves the right to add, remove, or modify platforms, features, and services at any time to improve functionality, user experience, and program effectiveness. Any such changes will be communicated to participating employees in a timely manner.

9. Product Use Disclaimer: By accessing and using any content, tools, services, or products provided within the Employ Well wellness portal, you acknowledge and agree to do so at your own risk. Employ Well makes no guarantees as to the outcomes or effectiveness of any third-party or in-house content. We are not responsible for how you use the content provided, nor for any results or consequences stemming from its use. Always consult a licensed professional before making any health, wellness, or financial decisions based on content accessed through the portal.

10. Employer Responsibility: Employers are solely responsible for the accuracy and completeness of employee data submitted for program enrollment. Employ Well assumes no liability for errors arising from incorrect or outdated payroll records provided by the employer.

11. Employee Separation: Employees who separate from their employer or become ineligible due to job status changes may lose access to program benefits, credits, or accounts. It is the responsibility of the employer to notify Employ Well of these changes.

12. Service Interruptions: Employ Well is not liable for temporary disruptions in service, platform access, or content availability caused by maintenance, technical issues, or third-party downtime.
